RECOMMENDED ACTION
recommendation
WHEREAS, pursuant to 10 TAC ?11.101(a)(1) of the 2024 Qualified Allocation Plan (QAP), Rehabilitation developments with no existing and ongoing federal assistance will only be allowed in the 100-year floodplain provided the local government has undertaken sufficient mitigation efforts, or the existing structures meet the requirements applicable for New Construction or Reconstruction Developments;
WHEREAS, the applicant anticipates applying for a Private Activity Bond reservation in August 2024, and submitting a 4% Housing Tax Credit application shortly after receiving said reservation;

WHEREAS, in advance of the application submission, the applicant has requested a waiver of 10 TAC ?11.101(a)(1) related to the floodplain requirements for Rehabilitation developments under the 2024 QAP;

WHEREAS, the proposed application is for a development located in Dickinson, Galveston County and the local government has not undertaken sufficient mitigation efforts nor do the existing structures meet the requirements applicable for New Construction or Reconstruction Developments;

WHEREAS, the applicant has proposed alternative mitigation efforts, including flood logs, flood passive barriers, berms and swales, as well as French drains, and perimeter drains to protect the property against flooding; and

WHEREAS, staff is neutral on whether the waiver should be granted on the basis that staff is unable to ascertain whether such alternative mitigation efforts would be adequate mitigation considering the entire City of Dickinson is in the 100-year floodplain.


NOW, therefore, it is hereby
