RECOMMENDED ACTION
recommendation
WHEREAS, the current rule relating to action that may be taken by the Department if outstanding balances are owed to the Department, at 10 TAC ?1.21, is in need of revisions, and such revision was proposed through the repeal of the current rule and a simultaneous new rule to be proposed in its place;
WHEREAS, the needed revisions include changes for consistency with recent revisions to Department processes, including removal of the prior process for the Executive Award Review and Advisory Committee (EARAC), clarification that this rule does not apply to specific multifamily processes, or vendors; and
WHEREAS, such proposed rulemaking was published in the Texas Register for public comment, no comment was received, and is now being returned to the Board for final adoption;
NOW, therefore, it is hereby
RESOLVED, that the Executive Director and his designees be and each of them hereby are authorized, empowered, and directed, for and on behalf of the Department, to cause the proposed actions herein in the form presented to this meeting, to be adopted and published in the Texas Register, and in connection therewith, make such non-substantive technical corrections as they may deem necessary to effectuate the foregoing including any requested revisions to the preambles.
