RECOMMENDED ACTION
recommendation
WHEREAS, pursuant to Tex. Gov't Code ?2306.053, the Texas Department of Housing and Community Affairs (the Department) is authorized to adopt rules governing the administration of the Department and its programs;
WHEREAS, pursuant to Tex. Gov't Code ?2001.039, state agencies are required to review a rule every four years to assess whether the reasons for initially adopting the rule continue to exist;
WHEREAS, staff recommends to the Board that there is a continuing need for this rule to exist, which is to provides the policy for the reallocation of financial assistance, including assistance related to bonds, administered by the Department if the Department's obligation with respect to that assistance is prematurely terminated as required by Tex. Gov't Code ?2306.111(h);
WHEREAS, the current rule relating to reallocation of financial assistance is in need of revisions to clarify that reallocation may occur not only for contracted funds, but also for funds that are committed or obligated, and in the case of funds that have been awarded but the awarded entity has failed to execute a contract;
WHEREAS, such revisions are being proposed through the repeal of the current rule and a simultaneous new rule to be proposed in its place; and
WHEREAS, such proposed rulemaking will be published in the Texas Register for public comment from February 20, 2026, through March 22, 2026, and subsequently returned to the Board for final adoption;
