RECOMMENDED ACTION
recommendation
WHEREAS, pursuant to Tex. Gov't Code ?2306.053, the Texas Department of Housing and Community Affairs (the Department) is authorized to adopt rules governing the administration of the Department and its programs;
WHEREAS, pursuant to Tex. Gov't Code ?2001.039, state agencies are required to review a rule every four years to assess whether the reasons for initially adopting the rule continue to exist;
WHEREAS, staff recommends to the Board that there is a continuing need for this rule to exist, which is to require that any person or entities doing business with the Department shall notify the Department of any change in contact information;
WHEREAS, the current rule is in need of revisions to remove reference to fax numbers and make other minor non-substantive revisions;
WHEREAS, such revisions are being proposed through an amendment to the current rule; and
WHEREAS, such proposed rulemaking will be published in the Texas Register for public comment from February 20, 2026, through March 22, 2026, and subsequently returned to the Board for final adoption;
NOW, therefore, it is hereby
RESOLVED, that the Executive Director and his designees be and each of them hereby are authorized, empowered, and directed, for and on behalf of the Department, to cause the proposed actions herein in the form presented to this meeting, to be published in the Texas Register for public comment, and in connection therewith, make such non-substantive technical corrections as they may deem necessary to effectuate the foregoing including any requested revisions to the preambles.
