RECOMMENDED ACTION

WHEREAS, Trinity East Senior is a 2025 9% Housing Tax Credit Application that requests $2,000,000 in Competitive Housing Tax Credits for the new construction of 90 affordable units in Houston;
WHEREAS, staff terminated the Application on April 1, 2025, due to the presence of a Neighborhood Risk Factor under 10 TAC ?11.101(a)(3)(D)(ii) relating to Part I violent crime rates exceeding acceptable thresholds;
WHEREAS, an appeal of the termination was timely submitted on April 8, 2025, asserting that crime-reduction efforts and neighborhood revitalization initiatives underway in the Third Ward community should reasonably support continued eligibility;
WHEREAS, Department staff determined that, while significant efforts toward crime reduction and community revitalization are underway, the evidence submitted does not sufficiently establish a reasonable expectation that the violent crime rate will fall below the threshold of 18 per 1,000 persons within two years; and
WHEREAS, while staff is unable to conclude that the site is eligible, the crime reduction strategies presented in the Application might provide assurance to a reasonable person that the Neighborhood Risk Factor is adequately mitigated;
NOW, therefore, it is hereby
RESOLVED, that the appeal of the termination of Trinity East Senior is either approved or denied.
