RECOMMENDED ACTION

WHEREAS, 10 TAC ?1.401, Effective Date and Definitions, provides for the effective date of when the uniform guidance for recipients of federal and state funds are in effect and had specified that Texas Grant Management Standards (TxGMS) 2.0 was the current version of the state grant standards;
WHEREAS, in October 2025 the Texas Comptroller of Public Accounts released the Texas Grant Management Standards (TxGMS), Version 2.1 which replaces TxGMS Version 2.0 and for which the version number and effective dates needed to be incorporated into the Department's rule;
WHEREAS, to put this rule into effect, such revision was proposed through the repeal of the current rule and a simultaneous new rule to be proposed in its place; and
WHEREAS, such proposed rulemaking was published in the Texas Register for public comment and no comment was received;
NOW, therefore, it is hereby
RESOLVED, that the Executive Director and his designees be and each of them hereby are authorized, empowered, and directed, for and on behalf of the Department, to cause the actions herein in the form presented to this meeting, to be published in the Texas Register, and in connection therewith, make such non-substantive technical corrections as they may deem necessary to effectuate the foregoing including any requested revisions to the preambles.
